ORDINANCE NO. 2965


AN ORDINANCE AMENDING SECTION 721B OF THE SEWER USE ORDINANCE, (APPENDIX A), OF THE LAKE COUNTY ORDINANCE CODE


INCREASING SEWER USE FEES FOR SOUTH LAKEPORT, LANDS END AND REEVES POINT (A.D. 9-1 AND A.D. 9-3)


The Board of Directors of the Lake County Sanitation District, State of California, ordains as follows:


Section 1: The SEWER SERVICE CHARGES in Section 721B of the Sewer Use Ordinance, (Appendix A), of the Ordinance Code of Lake County is hereby amended to read as follows:


“Sec. 721B. South Lakeport, Lands End and Reeves Point (A.D. 9-1 and 9-3) Sewer service charges. (The fees, tolls, rates, rentals or other charges for services and facilities furnished by the District in connection with its sanitary system are as follows:)

Includes: Each dwelling unit with sewer connections on


the same parcel; House, Mobile home, Apartment,

sewer service and any additional auxiliary unit (hooked up)


 

(2) LOW-STRENGTH COMMERCIAL – Base Charge $ 46.95 $ 46.95 $ 53.10


Per building with restroom or sewer connections


Includes: Professional office, Banks, Small Retail, Daycare or Day school


Without cafeteria or showers, Fellowship hall or church w/o commercial kitchen,


coffee shop without kitchen;


In addition to base rate:


Daycare or Day school without cafeteria or showers – per student $ 1.15 $ 1.30 $ 1.45


(3) MEDIUM-STRENGTH COMMERCIAL – Base Charge $125.85 $140.85 $159.85


Per building with restroom or sewer connections


Includes: Service Station without grocery or dining, Bars without dining,


Church, Fraternity, Club House, Senior Center, theaters, schools with


cafeteria and without showers, Convenience Stores without dining or kitchen,


Hotel/Motel without Dining, Hospital, Assisted Living, Group Homes, Detention


Center and Convalescent Home, Beauty Shop, Laundromat (self service),


Car Lots, Auto Shop, Small Grocery without deli or butcher shop;

Restaurants, Bars and Cocktail Lounges with Dining, Septage Disposal


(Dump Stations), Casino, Fitness Center, Event Center, Car Wash, Dry Cleaning,


RV and Camp Grounds.

(5) Minimum Charge for Wastewater Service not specifically itemized $41.95 $46.95 $ 53.10


Other wastewater uses in excess of minimum charge will be


evaluated on the basis of water use and components of discharge.


(6) CAPITAL IMPROVEMENT PROGRAM -per SFD equivalent $ 1.50 $ 3.00 $ 4.50


(7) When a specific connection type is not addressed, or easily identified, fees will be calculated on the flow data based on 210 gallons per day per single family dwelling unit (SFD) equivalent. Buildings or business entities that house multiple commercial type establishments will be billed for each establishment as it is categorized above.


The above sewer charges, items 1 through 5, including monthly charges and volume use charges, shall be adjusted February 15 of each year based on inflation. The inflationary adjustment shall be determined by multiplying the current rate by the ratio of the prior year’s average annual U.S. City Average Consumer Price Index as published by the U.S. Department of Labor, Bureau of Labor Statistics. In the event of a negative index, no change in the sewer charges shall be made.


SECTION 2: All ordinances or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of such conflict and no further.


SECTION 3: This Ordinance shall take effect on the 15th day of December, 2011, and before the expiration of fifteen (15) days after its passage, it shall be published at least once in a newspaper of general circulation printed and published in the County of Lake.


The foregoing Ordinance was introduced before the Board of Directors on the 8th day of November, 2011, and passed by the following vote on the 15th, day of November, 2011:

AMENDED NOTICE OF PUBLIC HEARING


NOTICE IS HEREBY GIVEN that the Planning Commission of the County of Lake, State of California, will hold a public hearing on application UP 11-09 requesting a five year time extension for an existing billboard sign.


The project applicant is La Monica Signs. The Planning Commission will reconsider the previously adopted mitigated negative declaration for this project based on Initial Study IS 96-08.


The project is located at 255 Soda Bay Road, Lakeport, APN 008-019-64.


The staff report will be available for review at the Community Development Department in the Lake County Courthouse, 255 North Forbes Street, Lakeport, California, ten (10) days before the hearing. NOTICE OF PUBLIC HEARING


NOTICE IS HEREBY GIVEN that the Planning Commission of the County of Lake will hold a public hearing on Westgate Petroleum’s application GPAP 11-01, RZ 11-01, GPD 11-01 and UP 11-13 proposing the following: (1) a general plan amendment of approximately 30,000 square feet from Agriculture to Service Commercial; (2) a rezone from “C3-DR-FF-AA”, Service Commercial – Design Review – Floodway Fringe – Airport Approach and “A-SC-AA”, Agriculture – Scenic – Airport Approach to “PDC-DR-FF-AA”, Planned Development Commercial – Design Review – Floodway Fringe – Airport Approach and “A-SC-AA”, Agriculture – Scenic – Airport Approach; (3) a general plan of development and use permit for a specific plan of development for bulk and retail fuel sales, outdoor storage of vehicles and propane, an office and a convenience store.
