NOTICE OF PUBLIC HEARING AND

SUMMARY OF PROPOSED ORDINANCE

NOTICE IS HEREBY GIVEN that the Board of Supervisors, County of Lake, State of California, has set TUESDAY, JUNE 26, 2012, AT 1:30 P.M., Board Chambers, Courthouse, Lakeport, as time and place to consider a proposed Urgency Measure prohibiting commercial medical marijuana cultivation and cultivation on vacant properties, and limiting outdoor cultivation amounts in the County of Lake, and declaring the urgency thereof.

A certified copy of the proposed Ordinance will be available at the Office of the Clerk of the Board of Supervisors on Friday, June 15, 2012.

This proposed interim urgency ordinance will prohibit commercial medical marijuana cultivation and cultivation of medical marijuana on vacant properties in all unincorporated areas of the County of Lake. Cultivation of medical marijuana in excess of the following amounts is proposed to be prohibited during the term of this ordinance:

1. Any cultivation on vacant lots or parcels.

2. Outdoor cultivation of more than 3 mature female plants (accessory to an approved residential use), is prohibited on any parcel smaller than 1/2 acre (21,780 square feet).

3. Outdoor cultivation of more than 6 mature female plants, accessory to an approved residential use, is prohibited on parcels ½ acre (21,780 square feet) or larger.

This interim urgency ordinance is proposed to be adopted for 45 days pending further study by County staff and the development of appropriate draft medical marijuana cultivation regulations by the Lake County Medical Marijuana Advisory Committee.

NOTICE IS FURTHER GIVEN that at said time and place any interested person may appear and be heard.

If you challenge the action of the Board of Supervisors on any of the above stated items in court, it may be limited to only those issues raised at the public hearing described in this notice or in written correspondence delivered to the Clerk of the Board of Supervisors at, or prior to, the public hearing.

SUMMARY OF ADOPTED ORDINANCE

NOTICE IS HEREBY GIVEN that the Board of Supervisors, County of Lake, State of California, adopted Ordinance No. 2976, AMENDING ARTICLE IX OF CHAPTER FIFTEEN OF THE LAKE COUNTY CODE RELATING TO THE INSPECTION PROGRAM FOR ALL WATER VESSELS LAUNCHED IN LAKE COUNTY.

This ordinance allows for the use of discretion by the enforcement officer regarding the issuance of a citation for violation of this code, from the level of infraction to misdemeanor; and modifies the penalties assessed for a citation, and establishes an appeal process through a hearing before the Board of Supervisors.

This ordinance was adopted by the Board of Supervisors on Tuesday, June 19, 2012, by the following vote:

AYES: Supervisors Comstock, Smith, Rushing, Farrington and Brown

NOES: None

ABSENT OR NOT VOTING: None

This ordinance will take effect on July 19, 2012.

SUMMARY OF ADOPTED ORDINANCE

NOTICE IS HEREBY GIVEN that the Board of Supervisors,County of Lake, State of California, adopted Ordinance No. 2974, AMENDING CHAPTER 2 OF THE LAKE COUNTY CODE TO AMEND VARIOUS PROVISIONS OF THE PURCHASING CODE. This ordinance clarifies the definition of various terms and processes, and codifies formal protest procedures, in conformance with a recent State Department ruling.  

This ordinance was adopted by the Board of Supervisors on Tuesday, June 19, 2012, by the following vote:

AYES: Supervisors Comstock, Smith, Rushing, Farrington and Brown

NOES: None

ABSENT OR NOT VOTING: None

This ordinance will take effect on July 19, 2012.
