Supervisors to hold rescheduled public hearing on hazardous vegetation abatement ordinance

LAKEPORT, Calif. – A public hearing on a proposed ordinance setting requirements for abating hazardous vegetation that was scheduled for last week will take place at this week’s Board of Supervisors meeting.

The board will meet beginning at 9 a.m. Tuesday, Dec. 11, in the board chambers on the first floor of the Lake County Courthouse, 255 N. Forbes St., Lakeport.

At 10 a.m., the board will hold a public hearing to consider draft ordinance No. 18-1083, which would add Article VIII to Chapter 13 of the Lake County Code regarding hazardous vegetation abatement in the county’s unincorporated area.

The proposed ordinance does not apply to properties in the cities of Clearlake and Lakeport.

An earlier draft of the ordinance had been set to go before the board last week but was rescheduled to this week, as Lake County News has reported.

Since last week, the document has had significant changes made to it. Changes can be seen primarily in the italicized sections in the document, however some new sections that were added are not in italics, such as Section 13-65, “Appeal of Notice and Order to Abate,” which replaces a similarly numbered but entirely different section, and Section 13-66, “Failure to Abate by Property Owner - Abatement by County Fire Official.”

In its opening paragraphs, the proposed ordinance – both its previous and current version – stated that “preventative actions taken now can greatly reduce both the occurrence, extent and severity of wildfires in the future.”

The new version added that “such actions must include deterring those who ignore the risk to neighbors and entire communities by failing to control hazardous vegetation on real property in their possession and/or control and who allow that risk to continue into the County’s fire season.”

It also adds language clarifying that its purpose is to ensure defensible space is maintained on the portions of unimproved parcels adjacent to improved parcels and along emergency access and evacuation routes and fire access easements.

In its definitions sections, subsections defining abatement and abatement costs are removed, as was a paragraph regarding a “county enforcement official.”

Those are replaced with new paragraphs about hazardous vegetation abatement costs and one that defines the “county fire official,” the individual who will wield significant power in determining which parcels are to be abated and what actions could be taken against landowners.

In the new wording, the proposed ordinance states, “The County Fire Official shall be the Chief Building Official for the County of Lake. In any enforcement and/or abatement action(s) undertaken pursuant to this Article, the County Fire Official may request assistance of any and all Enforcement Officials as defined in this Chapter as well as the assistance of any and all Fire Protection Districts within the County.”

The new ordinance draft also lays out clearer guidelines for how abatement notices shall be served, procedures for removing hazardous vegetation.

Under Section Sec. 13-68, “Violations and Penalties,” the updated draft ordinance clarifies how penalties are assessed, explaining that anyone failing to comply with the provisions “shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this Article is committed, continued or permitted by such person and shall be punishable accordingly.”

In the following section, Section 13-69, “Administrative Citations,” which is brand new, it explains that every violation “shall be punishable by (1) a fine of one hundred dollars ($100.00) per day per violation for a first violation, (2) a fine of two hundred dollars ($200.00) per day per violation for a second violation within one year; and (3) a fine of five hundred dollars ($500.00) per day per violation for each additional violation within one year.” That section also establishes a special account for the depositing of funds from fines.

6.4: Approve engineering/inspection agreement for integrated community development-between the county of Lake and 5400 Gaddy Lane, L.P., and authorize the chair to sign.

6.5: (a) Approve the bid award to McAtee’s Marine in the amount of $28,936.89 and (b) authorize the sheriff/coroner or his designee to issue a purchase order in this amount.

6.6: (a) Approve return of unexpended funds in the amount of $84,820.18 to the Drug Enforcement Agency (DEA); and (b) authorize the Auditor's Office to issue a check.

Lakeport Police Department seeks leads in felony burglary



LAKEPORT, Calif. – The Lakeport Police Department is asking for the public’s assistance in identifying the person responsible for an early morning burglary at a local restaurant.

At 6:45 a.m. Sunday an individual wearing a black hood and mask entered the back of Renee’s Cafe and took a purse belonging to an employee, according to a Lakeport Police report.

At the time of the incident the staff were preparing to open for customers, police said.

Surveillance video, shown above, caught the theft on tape. It showed the masked subject come into the building and avoid looking at the surveillance camera. The person went directly to a cupboard where the purse was kept, took it and fled.

The Lakeport Police Department said it is seeking the subject responsible for felony burglary and grand theft.

A $5,000 reward has been offered for information resulting in arrest and conviction of the subject, police said.

Lakeport Planning Commission to host special, end-of-year meeting

LAKEPORT, Calif. – The Lakeport Planning Commission will hold its last meeting of the year this week, during which it will consider several new projects.

The commission will meet at 5 p.m. Tuesday, Dec. 11, in the council chambers at Lakeport City Hall, 225 Park St.

On the agenda is an application from McDonald’s USA for architectural design and review that allows an additional drive-thru lane, signage, exterior and interior remodel of the existing McDonald’s restaurant building at 1077 Lakeport Blvd.

Big Daddy Garden Supply also has applied for a use permit for outdoor sales, a zoning permit for commercial fence and a sign permit along the northwestern corner of South Main Street and Lakeport Boulevard. The business will be located at 1015 S. Main St., the former location of the Napa Auto Parts - Lake Parts store, which has moved to 2440 S Main St.

The other main item of business is for the commission to review a general plan conformity report and categorical exemption for the proposed locations of the three solar canopies above existing parking areas at city-owned property located at City Hall at 75 Third St., the corporation yard at 591 Martin St. and the Lakeport Police Department at 2025 S. Main St.

The commission’s regular meeting of Wednesday, Dec. 12, has been adjourned.

After this week’s special meeting, the commission will next meet on Jan. 9.

Clearlake Planning Commission to hold special meeting on cannabis manufacturing project

CLEARLAKE, Calif. – The Clearlake Planning Commission is set to hold a special meeting on a proposal for a cannabis manufacturing project in the city limits.

The commission will meet at 6 p.m. Tuesday, Dec. 11, in the council chambers at Clearlake City Hall, 14050 Olympic Drive.

On the agenda is a planning application for Brian Galeprin of Bliss X for a cannabis manufacturing project, to be located in an existing building at 14915 Olympic Drive in Olympic Plaza.

The application includes a use permit conditionally allowing a cannabis operation in Unit K at the plaza, using approximately 4,500 square feet, and a development agreement for the operations.

Saturday night fire burns home in Lucerne

LUCERNE, Calif. – A Saturday night fire burned a home in Lucerne.

The fire in the 6200 block of Roland Drive was first reported just before 7:45 p.m. Saturday, according to scanner traffic.

The first Northshore Fire units to arrive within five minutes of dispatch reported finding heavy smoke and fire showing from the structure.

Power lines also were reported to be down, which made the firefighting effort more challenging, according to radio reports.

The fire was reported to have been knocked down just after 8:15 p.m., with mop up taking place over several hours afterward.

Radio reports indicated mop up was made more difficult because of the downed power lines. Pacific Gas and Electric was requested to report to the scene.

The structure appeared to be a total loss.

Reports at the scene on Saturday night indicated the fire may have originated in the kitchen.

Lakeport Police Department investigates case of stolen mail, packages

LAKEPORT, Calif. – The Lakeport Police Department said it’s investigating a case involving mail and packages found stolen from dozens of addresses.

On Saturday, officers were dispatched to the Bank of America building on N. Main Street where they recovered a significant amount of stolen mail and some packages with contents removed, police reported.

Police said the mail was from 33 different addresses, mostly south of First Street in the city of Lakeport and some from Highway 175 west of the city.

The investigation is ongoing and the agency said it will be attempting to contact the owners of the mail on Sunday.

Community members are urged to be aware that during the holiday season mail and package theft tends to increase.
