Proposed zoning ordinance amendments prohibiting marijuana cultivation in mobile home parks, multi-family dwelling properties

NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Planning Commission of the County of Lake, State of California, will hold a public hearing on application AM 12-01 and CE 12-53 proposing amendments to the Lake County Zoning Ordinance pertaining to prohibition of medical marijuana cultivation within mobilehome parks and multi-family dwelling properties, and setting limits on medical marijuana processing to the amounts that can be cultivated under local ordinance.  

The project applicant is the Lake County Community Development Department.

The Planning Commission will hold a public hearing to review the draft ordinance and to consider finding it be categorically exempt from the California Environmental Quality Act during a public hearing, prior to making a recommendation to the Board of Supervisors.  

The public hearing will be held in the Board of Supervisors’ Chamber in the Lake County Courthouse on December 13, 2012 at 10:25 AM, at which time and place interested persons may attend and be heard.  

The staff report and draft ordinance will be available for review 10 days before the hearing at the Community Development Department in the Lake County Courthouse, 255 North Forbes Street, Lakeport.

If you challenge the action of the Planning Commission on any of the above stated items in court, it may be limited to only those issues raised at the public hearing described in this notice, or in written correspondence delivered to the Lake County Planning Commission at, or prior to, the public hearing.

SUMMARY OF ORDINANCE NO. 2981

On November 27, 2012, the Board of Supervisors passed Ordinance No. 2981, amending Section 21-3.7 of Chapter 21 of the Ordinance Code of the County of Lake by adopting a Sectional District Zoning Map No. 3.7(b)1.386 rezoning a portion of the lands of Straessle and Zabel.

The zoning of these lands was changed from “RL-SC-WW-FF”, Rural Lands-Scenic-Waterway-Floodway Fringe to “RR-B5 (5 ACRE)-SC-WW-FF” Rural Residential-Special Lot Size (5 acre)-Scenic Waterway-Floodway Fringe.

This ordinance will take effect on December 27, 2012. A certified copy of the full text of the adopted ordinance has been posted at the Office of the Clerk of the Board, Courthouse, 255 North Forbes Street, Lakeport.

This ordinance was passed by the following vote:

AYES: Supervisors Comstock, Farrington and Brown
NOES: Supervisor Rushing
ABSENT OR NOT VOTING: Supervisor Smith Absent

ER Energy Lower Lake: Minor use permit for propane operation

NOTICE OF PROPOSED MINOR USE PERMIT

NOTICE IS HEREBY GIVEN that the Lake County Zoning Administrator will consider approving minor use permit MUP 12-21 for ER Energy Lower Lake in accordance with Lake County Code to allow the storage of bulk propane in a 30,000 gallon tank, two or fewer bulk delivery trucks, 75 or fewer individual propane tanks and necessary support equipment located on property at 10455 S. State Hwy 29, Lower Lake, CA, APN 012-028-22.

The Zoning Administrator will approve this MINOR USE PERMIT with no public hearing if no written request for a public hearing is submitted to the Community Development Department by 5:00 PM December 10, 2012.  

Should a timely request for hearing be filed, a public hearing will be held on December 19, 2012 at 2:00 PM in Conference Room C, 3rd Floor of the Courthouse, 255 N. Forbes St., Lakeport, CA.
