NOTICE OF PUBLIC HEARING AND
SUMMARY OF PROPOSED ORDINANCE


NOTICE IS HEREBY GIVEN that the Board of Supervisors, County of Lake, State of California, has set TUESDAY, DECEMBER 10, 2013, at 5:30 P.M., Fritch Hall, Lake County Fairgrounds, 401 Martin Street, Lakeport, as time and place to consider a proposed Ordinance amending Chapter 21 of the Ordinance Code of the County of Lake adding Article 72: Regulations for the Cultivation of Medical Marijuana (AM 13-01). A certified copy of the proposed Ordinance is available at the Office of the Clerk of the Board of Supervisors.

This ordinance proposes permanent regulations regarding the cultivation of medical marijuana within the unincorporated area of Lake County. The most pertinent provisions of this proposed ordinance are as follows: Indoor cultivation limited to 100 square feet; No outdoor cultivation within Community Growth Boundaries, or on parcels located outside said boundaries that are one (1) acre or smaller; Outdoor cultivation of six (6) mature or twelve (12) immature plants allowed on parcels outside Community Growth Boundaries and larger than one (1) acre; Collective or cooperative organizations comprised of local members allowed outdoor cultivation of 48 mature or 72 immature plants when located on “A”, Agriculture zoned property of at least 20 acres; Includes environmental standards to avoid impacts to surface waters; Includes detailed abatement and enforcement procedures and several options for fines, penalties and recovery of abatement costs.

NOTICE IS FURTHER GIVEN that at said time and place any interested person may appear and be heard.

If you challenge the action of the Board of Supervisors on any of the above stated items in court, it may be limited to only those issues raised at the public hearing described in this notice or in written correspondence delivered to the Clerk of the Board of Supervisors at, or prior to, the public hearing.

Ordinance No 2994: Establishing a fee schedule for driving under the influence programs

ORDINANCE NO 2994
AN ORDINANCE ESTABLISHING A FEE SCHEDULE FOR
DRIVING-UNDER THE-INFLUENCE PROGRAMS


The Board of Supervisors of the County of Lake, State of California, ordains as follows:

SECTION I: The amounts set forth below are hereby established as the fees for the services performed by the Department of Behavioral Health, Driving Under the Influence Program. The Department of Behavioral Health shall collect the fees set forth below as a condition for participating in the Driving Under the Influence program:

DUI Program (current fees)

12 – Hour Wet/Reckless Program: $260.00 per person
3 – Month First Offender Program (FOP): $545.00 per person
6 – Month First Offender Program (FOP): $740.00 per person
9 – Month First Offender Program (FOP): $1,150.00 per person
12 – Month Multiple Offender Program (MOP): $1,430.00 per person
18 – Month Multiple Offender Program (MOP): $1,580.00 per person
Missed Activity Fee: $30.00
Reinstatement Fee: $40.00
Transfer In/Out Fee: $50.00
Return Check Fee: $30.00

Additional Program Fees on the 9-Month First Offender Program (FOP) (fees requested for approval)

Increase amount: $80.00

SECTION 2: The assessment, collection and refunding of DUI Program Fees shall occur in accordance with State regulations

SECTION 3: All Ordinance or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of such conflict and no further.

SECTION 4: This ordinance shall take effect on the 19th day of December, 2013, and before the expiration of (15) days after its passage it shall be published at least once in a newspaper of general circulation in the County of Lake.

The foregoing ordinance was introduced before the Board of Supervisors on the 12th day of November, 2013 and passed by the following vote of the 19th day of November, 2013.

AYES: Supervisors Comstock, Rushing, Farrington and Smith

NOES: None

ABSENT OR NOT VOTING: Supervisor Brown

SUMMARY OF ORDINANCE NO. 2993

NOTICE IS HEREBY GIVEN that the Board of Supervisors, County of Lake, State of California, adopted Ordinance No. 2993, AN ORDINANCE AMENDING CHAPTER 2 OF THE LAKE COUNTY CODE CHANGING LIBRARY HOURS.

This ordinance shifts the hours of the libraries in Lakeport, Middletown and Upper Lake, and reduces the Redbud Library hours by one hour on Wednesdays.

A certified copy of the full text of the proposed ordinance is posted for public review on the First Floor of the Lake County Courthouse, 255 North Forbes Street, Lakeport, California.

This ordinance was adopted by the Board of Supervisors on Tuesday, November 12, 2013, by the following vote:

AYES: Supervisors Comstock, Rushing, Farrington, Brown and Smith

This ordinance will take effect on December 16, 2013.
