Ordinance No. 2013-163: An Ordinance of the City Council of the City of Clearlake Adding Section 12-28 of Chapter XII, Cable Communication Franchise of the Municipal Code of the City of Clearlake Enacting An Ordinance Relating to State Video Service Franchises

NOTICE IS HEREBY GIVEN that the Clearlake City Council adopted Ordinance No. 2013-163 on September 26, 2013.
The Ordinance authorizes the City to fully exercise the regulatory authority that it retains under the Digital Infrastructure and Video Competition Act of 2006, including to collect franchise fees and PEG fees, and obtain capacity for up to three public access, educational and governmental (PEG) channels.
The Ordinance was passed and adopted by affirmative vote of Mayor Joyce Overton, Vice Mayor Denise Loustalot, Council Members Joey Luiz and Gina Fortino Dickson, with Council Member Jeri Spittler absent.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning Commission of the County of Lake will hold a public hearing on Brookwood, LLC’s application RZ 05-19 and GPD 12-01 proposing the following: (1) a rezone from “RR-SC” Rural Residential – Scenic and “RL-WW” Rural Lands - Waterway to “PDR-SC-WW” Planned Development Residential; (2) a general plan of development for the establishment of a master-planned community with a maximum of 77 residential units clustered within the valley portion of the property.
Additional project amenities include an agriculturally oriented commercial parcel for winery and/or equestrian uses, a vineyard, an equestrian center with pasture, park, and network of private and public non-motorized trails.
The Planning Commission will consider recommending the Board of Supervisors adopt a mitigated negative declaration for this project based on Initial Study IS 12-29.
The project is located at 8150 and 8300 E. State Highway 20; 7250 and 7270 Cindy Lane; and 836 Pearl Court, Lucerne, CA: APNs 006-005-24, 49, 50 and 51; and 006-006-05.
The proposed mitigated negative declaration will be available for review 20 days before the hearing at the Community Development Department in the Lake County Courthouse, 255 North Forbes Street, Lakeport, and the staff report will be available 10 days before the hearing.

The public hearing will be held in the Board of Supervisors’ Chamber in the Courthouse on October 24, 2013 at 9:05 AM, at which time and place interested persons may attend and be heard.

NOTICE IS HEREBY GIVEN that the Clearlake City Council will consider adoption of Ordinance No. 2013-161 on September 26, 2013.
The ordinance bans commercial medical marijuana cultivation and cultivation on vacant properties, and limits cultivation amounts on developed properties.
