City of Clearlake: Aug. 19 special meeting on council candidates’ selection

CITY CLERK CERTIFICATE OF FACTS


THE FOLLOWING IS A CERTIFICATE OF FACTS PURSUANT TO ELECTION CODE SECTION 10229:

A. On June 4, 2020, the City Council of the City of Clearlake adopted Resolution No. 2020-25 Calling for and providing for and giving notice of the General Municipal Election to be held on Tuesday, November 3, 2020, for the Election of Three Council Members to serve the full four-year term of office

B. The City Clerk of the City of Clearlake posted the Notice of Election and the nomination period for three Council Members which began on Monday, July 13, 2020, and closed on Wednesday, August 12, 2020, at 5:00 p.m.

C. By close of the nomination period on Wednesday, August 12, 2020, two candidates were nominated for City Council. The two candidates are Joyce Overton and David Claffey.

D. Pursuant to California Elections Code section 10229, as of the close of the nomination period on Wednesday, August 12, 2020 for the General Municipal Election, there are not more candidates than offices to be elected and one of the following courses of action may be taken by the City Council:

1. Appoint to the office the person who has been nominated.
2. Appoint to the office any eligible voter if no one has been nominated.
3. Hold the election if either no one or only one person has been nominated.

E. If by the 75th day before the municipal election, no person has been appointed to the office(s) pursuant to (1) or (2) above, the election shall be held.

F. If the City Council makes an appointment pursuant to §10229, Elections Code, the City Clerk shall not accept for filing any statement of write-in candidacy which is submitted after the appointment is made.

G. If the City Council makes an appointment pursuance to §10229, Elections Code, the person(s) appointed, if any, shall qualify and take office and serve exactly as if elected at the municipal election for the office.

H. A notice that there are not more candidates than offices to be elected shall be posted and published in a newspaper of general circulation.

This matter will be considered by City Council of the City of Clearlake at a special meeting to be held on August 19, 2020 at 3:30 p.m. at Clearlake City Council Chambers, 14050 Olympic Drive, Clearlake, CA 95422.

NOTICE IS HEREBY GIVEN that the Planning Commission of the County of Lake, State of California, will hold a public hearing to consider MAJOR USE PERMIT (UP 18-48) on Thursday, August 13, 2020, 9:10 a.m., in the Board of Supervisors’ Chambers, 255 N. Forbes Street, Lakeport, California.

LAKE COUNTY, Calif. – To all interested stakeholders: Lake County Behavioral Health Services, in accordance with the Mental Health Services Act (MHSA), is publishing this Notice of 30-Day Public Comment Period and Notice of Public Hearing regarding the above-referenced document.

The public review and comment period began Tuesday, July 14, 2020, and ends at 5:00 p.m. on Wednesday, August 12, 2020. Interested persons may provide written comments during this public comment period.
