Ordinance to establish pass-through fee supporting cable access TV facilities

SUMMARY OF ORDINANCE NO. 2991


NOTICE IS HEREBY GIVEN that the Board of Supervisors, County of Lake, State of California, adopted Ordinance No. 2991, adding Article Seven to Chapter Seven of the Lake County Code to provide support for Public, Educational and Governmental (PEG) Cable television access facilities.
 
This ordinance will provide for a one-percent (1%) fee on the cable operator’s gross revenues, to be collected within the unincorporated areas of the County. The ordinance has a conditional effective date, pending a determination by the Attorney General that the PEG fee is not a tax subject to Proposition 26. A certified copy of the adopted ordinance is available in the Office of the Clerk of the Board, 255 North Forbes Street, Lakeport, CA 95453.
 
This ordinance was adopted by the Board of Supervisors on Tuesday, August 13, 2013, by the following vote:
 
AYES: Supervisors Rushing, Farrington and Smith
NOES: Supervisors Comstock and Brown
ABSENT OR NOT VOTING: None
